Terms of Use

This English version is a translation provided for convenience. The French version is the reference text.

1. Who you are contracting with

Watchin (“the App”) is published by Valentin Jouvenne (EI — sole proprietor), Sole proprietorship (French micro-entreprise), registered with the French National Business Register under SIREN number 908 403 561, whose address is 19 allée du Romarins, 13821 La Penne-sur-Huveaune, France (“we”, “us”). Contact: support@watchin-app.com.

By downloading or using the App you accept these Terms. They are available at any time at https://watchin-app.com/en/terms/ and can be printed or saved. If you do not accept them, do not use the App.

2. Licence: Apple’s standard licence agreement applies

The App is licensed to you under Apple’s Standard End User Licence Agreement (EULA) for apps distributed through the App Store: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.

These Terms supplement that EULA. Where they conflict, Apple’s Standard EULA prevails for the matters it covers, and these Terms govern the rest.

3. What the App is, and what it is not

Watchin is an independent third-party app for Trakt that lets you keep track of the movies and shows you watch. It is:

  • not published, endorsed, certified or operated by Trakt;
  • not published, endorsed or certified by TMDB, IMDb, Rotten Tomatoes, Metacritic, Letterboxd, JustWatch, Apple, or any streaming service mentioned in the App;
  • not a source of movies or shows: the App streams, hosts and provides no means of obtaining any video. Availability information is for information only.

All trademarks mentioned belong to their respective owners.

4. You need a Trakt account

The App’s main features require a Trakt account, created and managed with Trakt under its terms (https://trakt.tv/terms) and privacy policy (https://trakt.tv/privacy). Some features, marked in the App, need a Trakt VIP subscription, sold by Trakt and not by us.

Your Trakt account and its content are a matter between you and Trakt. We do not operate any service that holds your data, we have no access to your Trakt account and cannot delete it.

You are responsible for keeping your Trakt credentials confidential.

5. Price

The App is free today and contains no advertising.

If a paid feature or optional subscription is offered, it will be sold and billed by Apple through the App Store, at the price shown before purchase, under Apple’s terms. Subscriptions are managed, renewed, cancelled and refunded from your Apple Account settings or at https://reportaproblem.apple.com. Free features existing on the day of your purchase will not become paid without prior notice.

6. Acceptable use

You agree not to:

  • use the App in breach of the terms of Trakt, TMDB or any other referenced service;
  • harass, insult or defame anyone, including through comments posted to Trakt from the App — those comments are published on Trakt, under its rules and moderation;
  • circumvent technical protections, rate limits or API quotas;
  • decompile or disassemble the App, except to the extent permitted by law (Article L.122-6-1 of the French Intellectual Property Code and Article 6 of Directive 2009/24/EC);
  • redistribute, rent, resell or sublicense the App.

7. Third-party data and content

Title pages, artwork, ratings and availability come from third parties (Trakt, TMDB, JustWatch via TMDB, OMDb, Wikidata, YouTube). We are not their author and cannot guarantee that they are accurate, complete or up to date. If a third party changes, restricts or discontinues its service, the corresponding feature may change or disappear.

Attribution required by those providers:

  • This product uses the TMDB API but is not endorsed or certified by TMDB.
  • Watchin uses the Trakt API but is not affiliated with, endorsed or certified by Trakt.
  • Availability data provided by JustWatch.

8. Updates and availability

We use our best efforts to keep the App working properly, and update it to fix defects, keep it secure or follow changes in the third-party services it depends on. Updates needed to keep the App in conformity are provided free of charge, in accordance with Articles L.224-25-12 et seq. of the French Consumer Code.

9. Your data

How your data is handled is described in the Privacy Policy: https://watchin-app.com/en/privacy/.

In short: no analytics, no tracking, no advertising, no server of ours. Your library lives in your Trakt account; the App keeps a local copy on your device.

10. Warranties and liability

You benefit from the legal guarantee of conformity for digital content and services (Articles L.224-25-12 et seq. of the French Consumer Code) and, where applicable, from the other mandatory legal guarantees of your country of residence. Nothing in these Terms limits them, or excludes our liability for personal injury, fraud or gross negligence.

Subject to the above, and to the extent permitted by law, we are not liable for indirect damage, for the loss of data held by third parties (including Trakt), or for loss arising from the unavailability or inaccuracy of a third-party service.

The App’s local database is a cache and may be rebuilt at any time. Your reference record is your Trakt account.

11. Termination

You may stop using the App at any time by signing out and deleting it. If you seriously breach these Terms, we may terminate your licence; you must then stop using the App. Your Trakt account is unaffected.

12. Terms required by Apple for the App Store

The following apply to any copy of the App obtained from the App Store:

  1. Acknowledgement. These Terms are concluded between you and us only, not with Apple. We, not Apple, are solely responsible for the App and its content.
  2. Scope of licence. The licence is a non-transferable licence to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, except that the App may be accessed by other accounts associated with you via Family Sharing or volume purchasing.
  3. Maintenance and support. We are solely responsible for maintenance and support, as set out in these Terms or required by law. Apple has no obligation whatsoever to furnish any maintenance or support services.
  4. Warranty. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are our sole responsibility.
  5. Product claims. We, not Apple, are responsible for addressing any claims relating to the App or your possession and use of it, including: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation, including in connection with the use of the HealthKit and HomeKit frameworks (which the App does not use).
  6. Intellectual property. In the event of any third-party claim that the App or your possession and use of it infringes that third party’s intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
  7. Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

  9. Third-party beneficiary. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

13. Complaints and mediation

For any complaint, please write to us first at support@watchin-app.com: we will reply as soon as possible.

The App is provided free of charge, with no payment and no personal data provided in return: no paid sales or service contract is concluded, so consumer mediation (Articles L.611-1 et seq. of the French Consumer Code) does not apply at this stage. A mediator will be appointed, and named here, before any paid offer. You keep the right to bring proceedings before the competent courts.

14. Governing law and jurisdiction

These Terms are governed by French law. If you are a consumer residing in the European Union, you also benefit from the mandatory provisions of the law of your country of residence, and may bring proceedings before the courts of that country or of France.

15. Changes to these Terms

We may change these Terms, in particular to follow the law or changes to the App. The version in force is the one published on this page, with its date. Any significant change will be announced in the App or on this website before it takes effect; if you do not accept it, you may stop using the App at any time, at no cost.
